Please read these Terms and Conditions (“Terms”) carefully before using the Floyd’s House, Inc. website (the “Site”) operated by Floyd’s House, Inc. (“us”, “we”, or “our”).

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site.

These Terms govern your use of this website only. They do not govern admission, housing eligibility, resident services, case management, or other Floyd’s House programs.

SMS and Text-Messaging Terms

Program Description

Floyd’s House, Inc. (“Floyd’s House,” “we,” “us,” or “our”) may offer text-message communications to individuals who affirmatively agree to receive them. Depending on the consent you provide, messages may include:

  • Responses to your inquiries.
  • Information you request about Floyd’s House or its programs.
  • Meeting, appointment, event, or activity confirmations and reminders.
  • Volunteer-related communications.
  • Organizational news and updates.
  • Fundraising or donation-related messages.

Fundraising, promotional, event, and organizational-news messages will be sent only to individuals who separately agree to receive those categories of messages.

Consent to Receive Messages

You may enroll by completing a Floyd’s House form containing an SMS consent option or through another opt-in method clearly identified by Floyd’s House. By affirmatively opting in, you authorize Floyd’s House and its text-messaging service providers to send recurring text messages to the mobile number you provide. Messages may be sent using automated technology.

Consent to receive text messages is voluntary and is not a condition of making a donation, requesting information, applying for assistance, participating in a program, or receiving services from Floyd’s House.

By enrolling, you represent that you are the subscriber or customary user of the mobile number provided or that you have the subscriber’s permission to enroll that number.

Message Frequency and Charges

Message frequency varies depending on your interactions with Floyd’s House and the categories of messages you have agreed to receive.

Floyd’s House does not charge a separate fee for its text-message program. Message and data rates may apply according to the terms of your wireless-service plan. Contact your wireless provider with questions about your text or data plan.

Opting Out

You may withdraw your consent at any time by replying STOP, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT to a Floyd’s House text message. You may also contact us at support@floydshouse.org or 865-410-5535.

Floyd’s House will treat any reasonable communication clearly expressing that you no longer wish to receive text messages as an opt-out request. After receiving an opt-out request, we may send one final, nonpromotional message confirming that the request has been processed. No further messages requiring your consent will be sent unless you affirmatively enroll again.

If you have enrolled in more than one category of messages, we may ask whether you intend to stop all text messages or only a particular category. Unless you clearly indicate otherwise, Floyd’s House may treat your request as withdrawing consent from all text-message categories.

Getting Help

For assistance, reply HELP to a Floyd’s House text message, email support@floydshouse.org, or call 865-410-5535.

Delivery and Availability

Wireless carriers are not responsible for delayed or undelivered messages. Message delivery is subject to network availability, wireless-provider services, device compatibility, and other conditions outside Floyd’s House’s control. Floyd’s House does not guarantee that every message will be delivered or received.

We may modify, suspend, or discontinue all or part of the text-message program when reasonably necessary. Ending the program will not affect privacy or opt-out obligations relating to information already collected.

Telephone-Number Changes

You agree to notify Floyd’s House if you stop using or relinquish a mobile number enrolled in the text-message program. This helps prevent messages from being sent to a person who later receives that number.

Mobile-Information Privacy

Floyd’s House does not sell, rent, or share mobile telephone numbers, SMS opt-in information, or text-message consent records with third parties or affiliates for their own marketing or promotional purposes.

Floyd’s House may provide mobile information to text-messaging platforms, telecommunications providers, and subcontractors solely as necessary to deliver, administer, support, and secure Floyd’s House communications. Those providers are not authorized to use the information for their own marketing.

For additional information about how Floyd’s House collects, uses, retains, and protects personal information, please review our Privacy Policy.

Donations

Donation Processing

Donations made through this website are contributions to Floyd’s House, Inc. and support its charitable mission. Unless Floyd’s House expressly accepts a donor restriction in writing, donations are unrestricted and may be used where they are most needed to further the organization’s charitable purposes.

Online donations may be processed by a third-party payment processor. By submitting a donation, you authorize Floyd’s House and its payment processor to charge the payment method you provide for the amount shown at the time of submission. You agree to provide accurate and current payment and contact information.

The payment processor may apply its own terms of service and privacy policy to the information it processes.

Floyd’s House reserves the right to decline or return a donation when reasonably necessary, including when a donation is unlawful, inconsistent with the organization’s charitable mission, subject to an unacceptable restriction, or associated with suspected fraud or misuse.

Recurring Donations

If you establish a recurring donation, you authorize the selected amount to be charged at the frequency shown when you enroll. Recurring donations will continue until canceled.

You may cancel future recurring donations through the payment processor’s donor portal, if available, or by contacting Floyd’s House at support@floydshouse.org.

A cancellation applies to future charges and may not reverse a payment that has already been submitted for processing. Please submit cancellation requests sufficiently in advance of the next scheduled charge to allow the request to be processed.

Refunds

Donations are generally final and nonrefundable.

If you believe a donation was made in error, entered in the wrong amount, duplicated, or made without the payment-method holder’s authorization, contact Floyd’s House at support@floydshouse.org within 30 days of the transaction.

Floyd’s House will review refund requests in good faith. A refund may be issued when required by law or when Floyd’s House determines that a refund is appropriate under the circumstances. Approved refunds will ordinarily be returned to the original payment method. Floyd’s House does not guarantee that every refund request will be approved.

Tax Deductibility and Donation Acknowledgments

Floyd’s House, Inc. is recognized by the Internal Revenue Service as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code.

Contributions are tax-deductible only to the extent permitted by applicable law. If a donor receives goods or services in exchange for a payment, only the portion exceeding the fair market value of those goods or services may be deductible.

Floyd’s House will provide donation acknowledgments as required by applicable law. Each donor is responsible for retaining appropriate records and determining the tax treatment of a contribution. Nothing on this website constitutes tax, legal, or financial advice. Donors should consult their own professional advisers regarding their individual circumstances.
